This case is prosecuting age discrimination claims on behalf of a class current and former salaried exempt 3M employees in Minnesota who did not sign a release of their claims. Federal Case - Garcia et al. v. 3M Company: this is a federal lawsuit filed in the United States District Court, Northern District of California. This case is prosecuting age discrimination claims on behalf of six plaintiffs and similarly situated current and former salaried exempt and non-exempt 3M employees across the U.S., including persons who signed a release of their claims. Eligible persons must opt in to this case to participate in it. To date, 91 persons have chosen to opt in to the case in addition to the 6 named plaintiffs. Am I A Class Member in the Whitaker Case?
The class that Judge Johnson certified in the Whitaker case includes all current and former employees of 3M who were
- age 46 or older when employed by 3M in Minnesota
- at any time from May 10, 2003, through the present
- in a salaried, exempt position below PS grade180 (grade 18) or L3, and
- who did not sign a release of claims
If you fall within the definition, you are likely a class member and will receive a notice that tells you about your rights. We do not know when notices will be sent, but will post the information on this website when it is available.
